The 50,000 euro no-collateral threshold is set by Orden HFP/311/2023; above it, you need bank guarantees or other security and the procedure gets heavier. If you are also late with a return, the right order of steps is in the guide I missed a deadline.
In practice, when you file the return you choose the option to request a deferral or instalments instead of paying, and then you complete the request with the payment schedule you propose and the account to be debited. If you apply within the voluntary payment period, the enforcement surcharge is not demanded while the request is being processed. The tax agency can grant it, ask you to fix it or reject it, and the decision arrives in your electronic notifications mailbox.
The typical mistake is treating it as free financing. The deferred amount accrues late-payment interest and, if you miss an instalment, the outstanding debt can move into the enforcement period with its surcharges. On top of that, some debts cannot be deferred by law, such as the withholdings you deducted from others: that money was never yours.
It is often used for VAT returns, personal income tax instalments and corporate tax. If the debt comes from a sanción tributaria or a surcharge, it can be deferred too. Before you apply, check your cash flow forecast so you choose instalments you can really meet.
